Homosexualitat i perillositat social: bases mèdiques i científiques d'una llei tardofranquista

Antoni Adam Donat, Àlvar Martínez Vidal

The Spanish Ley de Peligrosidad y Rehabilitación Social, promulgated
in 1970 during the late Francoist regime and derogated ten years later at the beginning
of the democracy, increased the social exclusion suffered by homosexual persons.
This law considered homosexuality as a very perverse sexual tendency, potentially
contagious and socially dangerous.
This paper intends to identify the scientific bases in which this law was rooted, specially
the psychiatric and legal medical arguments offered by legislators in order to justify
a set of preventive and punitive actions against homosexual behaviour.
